The regular semi-monthly meeting of the Board of Trustees of the Village of Menands, held on Monday, December 4th, 2017 was called to order by Mayor Megan Grenier at 6:00 P.M.

The Mayor led the Pledge of Allegiance.

The Clerk read the Notice:

At 6:00 P.M. the Mayor opened the Public Hearing for a proposed Local Law # 3 of 2017 to amend Article XII Traffic and Parking Regulations Section 160.66 Parking prohibited in certain locations.

A Public Hearing will be held on Monday, December 4, 2017 at 6:00 P.M. in the Village Municipal Building located at 250 Broadway for a proposed Local Law # 3 of 2017 to amend Article XII Traffic and Parking Regulations Section 160.66 Parking prohibited in certain locations. The regular meeting to follow. Such public hearings are open to the public and are accessible to the handicapped. All are encouraged to attend or to present comments in writing.

They Mayor explained Local Law # 3 and the purpose for change.

Resident Marcella Rockwell asked when Local Law # 3 would go into effect.

Attorney Rehfuss explained that the Local Law has to go to the State for approval it takes approximately thirty (30) days when the Village hears back the law goes into effect.

Trustee Nicoll read the amendment to

LOCAL LAW # 3 OF 2017

§ 160-66. Parking prohibited in certain locations. [Amended 6-7-1993 by L.L. 2-1993; 7-19-1993 by L.L. No. 3-1993; 11-15-1993 by L.L. No. 4-1993; 9-7-1999 L.L. No. 1-9999;7-2-2001 by L.L. No. 2-2001; 8-20-2001 by L.L. No. 5-2001]

It shall be unlawful and a violation of this article for an owner or operator of any vehicle to park or permit his vehicle to be parked or to abandon his vehicle:

A. On the west side of North Pearl Street from point 127 feet south of Amsterdam Avenue to the end thereof north of Amsterdam Avenue.

B. On the north side of Clifford Road from Broadway west to the west end thereof.

C. On both sides of Hampton Street between Amsterdam Avenue and Wolfert Avenue.

D. On the east side of Park Hill Drive from Wards Lane to a point on the east side of said Park Hill Drive 439 feet to the north thereof.

E. On either side of Amsterdam Avenue east of North Pearl Street to the end thereof.

F. On the east side of North Pearl Street from a point +/-83 feet south on North Pearl Street.

G. On either side of Jones Court.

Seconded by Trustee Foley.

Hearing no further questions or comments the Mayor thanked everyone for their input and closed the Public Hearing at 6:04 P.M.

The regular meeting convened at 6:04 P.M.

A motion was made by Trustee Nicoll to amend Local Law # 3 of 2017 Article XII Traffic and Parking Regulations Section 160.66 Parking prohibited in certain locations. To include G. On either side of Jones Court., seconded by Trustee Foley.

Open Forum:

Resident Brian Marsh thanked DPW for their hard work and for picking up leaves.

Eric Johnson from Chazen Companies gave the Board updates on Village Capital Projects.

A motion was made by Trustee Harris, seconded by Trustee Foley to approve minutes from the 2017 Insurance Workshop as amended.

Resolution of the Menands Village Board
Adopting a SEQRA Negative Declaration and
Granting a Special Use Permit for Broadway Apartments Site Plan
35 Broadway in Menands S. B. L. 55.17-1-56

Whereas, the owners of 35 Broadway, S. B. L. 55.17-1-56, desire to construct a 100-unit apartment building on said parcel within the Broadway Business District (BBD); and

Whereas, Section 169 of the Menands Code identifies multifamily dwelling units as Uses Permitted by Special Use Permit in the BBD; and

Whereas, a preapplication conference was held on September 18, 2017; and

Whereas, the Village Board, on September 18, 2017, determined that the application submitted a complete special use permit application in accordance with Section 169-47 of the Menands Code; and

Whereas, a public hearing was held on October 17, 2017 at 6:00 P.M. for the purposes of considering the special use permit; and

Whereas, the applicant provided responses to each of the Special Use Permit Standards in 169-48 of the Village Code; and

Whereas, the Village Board has considered if the special use satisfies the Special Use Permit Standards in 169-48 of the Village Code; and

Whereas, the applicant prepared and completed Part 1 of the Short Environmental Assessment Form for the proposed action; and

Whereas, the applicant has requested the Village Board to conduct an uncoordinated environmental (SEQRA) review; and

Whereas, the Village Board has identified themselves as the Lead Agency and has classified the project as an Unlisted action under SEQRA; and

Whereas, the Village Board reviewed the Short Environmental Assessment Form as well as the project application materials,

Now, Therefore Be It Resolved that based on a review of this application and the Environmental Assessment form and supporting materials, on November 20, 2017, the Village Board hereby issues a SEQRA Negative Declaration.

Trustee Harris made a motion to except a SEQRA Negative Declaration for 35 Broadway in Menands, as provided by SBKJ Associates seconded by Trustee Foley.

Village Attorney Rehfuss explained the Village had concerns and wanted to add conditions to the Special Use Permit.

Further, the Village Board hereby issues a Special Use Permit with the following conditions:

The applicant shall provide documentation to the satisfaction of the Village Board which identifies that the project has proper financing in place prior to the Village Board issuing final site plan approval.
Should the Village Board grant final site plan approval and a building permit is issued, the duration from building permit issuance to completion of construction and certificate of occupancy issuance shall be no longer than 18-months.
The Village Board reserves the right to request a traffic impact study from the application during the site plan review process.
During the site plan review process, the applicant shall submit certain design details, including but not limited to, building form and facades, for the Village’s review and approval. The Village reserves the right to require specific design of the building form and facades.
That the approval of the Special Use Permit is unique, directed to and approved for the applicant, Boswell Engineering only.

Trustee Harris made a motion to grant a Special Use Permit to SBKJ Associates at 35 Broadway to construct a 100-unit Apartment Project, seconded by Trustee Foley.

Don Adams from Creighton Manning explained changes that are recommended for Signage within the Village including Stop Sign Assessment. There are nine (9) stop signs that need replacement. A discussion followed.

Resident Marsh expressed his concerns about removing stop signs on Sage Hill Lane, North Sage Hill Lane and on Pateman Circle.

Attorney Rehfuss advised the Board to wait until next meeting to introduce Resolution so they could read through the recommended changes. The Board agreed.

The Clerk advised that the 2018 – 2019 Delinquent Taxes were sent to Albany County for Collection are as follow:

Tax: $120,858.56
Property Maintenance: $ 5,840.00
Reassessed Water: $ 43,294.48
Interest: $ 13,599.48
$183,592.52

A reminder to the Board of the Public Hearing scheduled for Tuesday, December 5th, at 5:00 P.M. to provide information on a project in collaboration with the University of Albany Department of Geography and Planning, Master’s in Regional Planning Program Graduate Studio.

The Mayor stated that the Christmas Tree Lighting at Ganser Smith Park was a success.

Trustee Harris thanked Diane Leonard and the Seniors for inviting the Board to the Seniors Christmas Party it was a very good time.

The Clerk gave the Board a reminder of the Annual Christmas Party for employees, retired employees and their guests is scheduled for Thursday, December 14th, 2017 from 3:00 P.M. to 6:00 P.M. at Poppy’s Place.

Don Handerhan thanked the Board and residents for support they have given his family and himself over the past two months.
A motion was made by Trustee Harris, seconded by Trustee Foley to adjourn.
