Board Meeting Minutes – January 16th, 2018

The regular semi-monthly meeting of the Board of Trustees of the Village of Menands, held on Monday, January 16th, 2018 was called to order by Mayor Megan Grenier at 6:00 P.M.

The Mayor led the Pledge of Allegiance.

During the last watermain break on Van Rensselaer Blvd. DOT advised Mike Hagmann, that the road signs that DPW is currently using do not comply with DOT standards and need to be replaced.

DPW was also advised by DOT while working on the watermain break during the nighttime, DPW must have light plant to provide enough light to work on the Highway. During the same watermain break DPW had to stop work and go rent a light plant.

Trustee Harris made a motion to purchase a light plant for DPW, from Skyworks at cost of $8,200.00. After recommendation made by Mike Hagmann the Skyworks Unit is a smaller unit ant the lights do not hang over the unit. This will allow for better storage in the DPW garage, less space while in use and less chance of damage during transport. Seconded by Trustee Nicoll.

Open Forum:

Bill Garvey thanked the village for the get-well card and for the prayer said for him. On South Lyons Avenue there is a sign pole down and signs are faded on East Kenmar Road. At the Stewarts Shop the fire extinguisher was blocked he moved the item blocking the extinguisher. Mayor Grenier advised Mr. Garvey he really shouldn’t move items it is not his responsibility.

The Mayor thanked DPW for their hard work.

A motion was made by Trustee Nicoll, seconded by Trustee Boulet to accept the minutes of the January 2nd, 2018 Board Minutes.

Brian Marsh expressed his concerns about removing the stop sign at North Sage Hill Lane eastbound at Sage Hill Lane. A discussion followed.

Trustee Harris presented the following resolution for local law number 1 of 2018 amending the Village Code 160 of the Village of Menands to Vehicle and Traffic regulations. Be it enacted by the Village Board of the Village of Menands as follows:

ARTICLE III
Designation of Main Arteries of Travel
[Adopted 6-23-1931] § 160-28 Enumeration of main arteries.
The following streets or portion of streets are hereby designated as main arteries of travel:
North Pearl Street, between the north boundary line of the City of Albany and the north end of the present pavement on said North Pearl Street.
Amsterdam Avenue, between Van Rensselaer Boulevard and North Pearl Street.

§ 160-31 Exclusion of heavy trucks from certain Village highways and streets.
[Amended 6-6-2016 by L.L. No. 3-2016] A. Glenwood Road between Broadway and the access road to the Menands overcrossing, Wolfert Avenue between Van Rensselaer Boulevard and North Pearl Street, Amsterdam Avenue between Van Rensselaer Boulevard and North Pearl Street and Hendrick Avenue between Van Rensselaer Boulevard and Amsterdam Avenue are hereby designated as Main Arteries in the Village of Menands from which heavy trucks shall be excluded.
B. The regulations established in this section shall not apply to the following:
(1) Commercial vehicles while they are actively engaged in the delivery or pickup of merchandise or other property to a residential address along the highways from which such vehicles are otherwise excluded.
(2) Authorized emergency vehicles engaged in emergency operations along the highways from which such vehicles are otherwise excluded.
(3) All public transit buses or any other vehicles providing services to the persons or property along the highways from which such vehicles are otherwise excluded.
§ 160-66 Parking prohibited in certain locations.
[Amended 6-7-1993 by L.L. No. 2-1993; 7-19-1993 by L.L. No. 3-1993; 11-15-1993 by L.L. No. 4-1993; 9-7-1999 by L.L. No. 1-1999; 7-2-2001 by L.L. No. 2-2001; 8-20-2001 by L.L. No. 5-2001] It shall be unlawful and a violation of this article for an owner or operator of any vehicle to park or permit his vehicle to be parked or to abandon his vehicle:
A. On the west side of North Pearl Street from point 127 feet south of Amsterdam Avenue to the end thereof north of Amsterdam Avenue.
B. On the north side of Clifford Road from Broadway west to the west end thereof.
C. On both sides of Hampton Street between Amsterdam Avenue and Wolfert Avenue.
D. On the east side of Park Hill Drive from Wards Lane to a point on the east side of said Park Hill Drive 439 feet to the north thereof.
E. On either side of Amsterdam Avenue east of North Pearl Street to the end thereof.
F. On the east side of North Pearl Street from the southeast corner of Amsterdam Avenue and North Pearl Street continuing +/-30 feet south on North Pearl Street.
G. On the east side of North Pearl Street from the northeast corner of Amsterdam Avenue and North Pearl Street continuing +/-30 feet north on North Pearl Street.
H. On either side of Jones Court.

ARTICLE III
Designation of Stop Intersections
[Adopted 9-16-1996 by L.L. No. 2-1996]

§ 160-74 Menand Road and Lyons Avenue.
All traffic approaching the intersection of Menand Road and North Lyons Avenue from North Lyons Avenue must come to a full stop prior to entering such intersection unless otherwise directed by a peace officer or signal. Such intersection is hereby designated as a stop intersection.
§ 160-77 Sage Hill Lane and Pateman Circle.
All traffic approaching the intersection of Sage Hill Lane and Pateman Circle from northerly Pateman Circle must come to a full stop prior to entering such intersection unless otherwise directed by a peace officer or signal. Such intersection is hereby designated as a stop intersection.
§ 160-78 Pateman Circle and Graffunder Drive.
All traffic approaching the intersection of Pateman Circle and Graffunder Drive travelling in a southerly direction on Graffunder Drive, must come to a full stop prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. Such intersection is hereby designated as a stop intersection.
§ 160-80 MacAffer Drive and Momrow Terrace.
All traffic approaching the intersection of MacAffer Drive and Momrow Court travelling in a westerly direction on MacAffer Drive, must come to a full stop prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. Such intersection is hereby designated as a stop intersection.
§ 160-86 Sky Hollow Drive and MacAffer Drive.
All traffic approaching the intersection of Sky Hollow Drive and MacAffer Drive, travelling in a southerly direction on Sky Hollow Drive, must come to a full stop prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. Such intersection is hereby designated as a stop intersection.
§ 160-87 Newell Court and Folmsbee Drive.
All traffic approaching the intersection of Newell Court and Folmsbee Drive, travelling in a northerly direction on Folmsbee Drive, and an easterly direction on Newell Court, most come to a full stop prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. Such intersection is hereby designated as a stop intersection.
§ 160-88 Norwood Drive and Newell Court.
All traffic approaching the intersection of Norwood Drive and Newell Court, travelling in a northerly direction on Norwood Drive, must come to a full stop prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. Such intersection is hereby designated as a stop intersection.
§ 160-89 Norwood Drive and Folmsbee Drive.
All traffic approaching the intersection of Norwood Drive and Folmsbee Drive travelling in an easterly direction on Norwood Drive, must come to a full stop prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. Such intersection is hereby designated as a stop intersection.
§ 160-90 Dennin Drive and Folmsbee Drive.
All traffic approaching the intersection of Dennin Drive and Folmsbee Drive travelling in an easterly direction on Dennin Drive, must come to a full stop prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. § 160-91 Momrow Court and Newell Court.
All traffic approaching the intersection of Momrow Court and Newell Court travelling in a northerly direction on Momrow Court, must come to a full stop prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. Such intersection is hereby designated as a stop intersection.
§ 160-92 Momrow Court, Momrow Terrace and Folmsbee Drive.
All traffic approaching the intersection of Momrow Court, Momrow Terrace and Folmsbee Drive travelling in an easterly direction on Folmsbee Drive, must come to a full stop prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. § 160-93 Scott Drive and Wards Lane.
All traffic approaching the intersection of Scott Drive and Wards Lane travelling in a northerly direction on Scott Drive, must come to a full stop prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. Such intersection is hereby designated as a stop intersection.
§ 160-94 Highland Street and Hendrick Avenue.
All traffic approaching the intersection of Highland Street and Hendrick Avenue travelling in a southerly direction on Highland Street, must come to a full stop prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. Such intersection is hereby designated as a stop intersection.
§ 160-95 Hampton Street and Hendrick Avenue.
All traffic approaching the intersection of Hampton Street and Hendrick Avenue travelling in a southerly direction on Hampton Street, must come to a full stop prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. Such intersection is hereby designated as a stop intersection.
§ 160-96 Pawling Street and Hendrick Avenue.
All traffic approaching the intersection of Pawling Street and Hendrick Avenue travelling in a southerly direction on Pawling Street, must come to a full stop prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. Such intersection is hereby designated as a stop intersection.
§ 160-97 Kingston Street and Hendrick Avenue.
All traffic approaching the intersection of Kingston Street and Hendrick Avenue travelling in a southerly direction on Kingston Street, must come to a full stop prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. Such intersection is hereby designated as a stop intersection.
§ 160-98 Canal Road and Irving Place.
All traffic approaching the intersection of Canal Road and Irving Place travelling in a southerly direction on Canal Road, must come to a full stop prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. Such intersection is hereby designated as a stop intersection.
§ 160-99 Canal Road and East Elmwood Road.
All traffic approaching the intersection of Canal Road and East Elmwood Road travelling in a northerly direction on Canal Road, must come to a full stop prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. Such intersection is hereby designated as a stop intersection.
§ 160-100 Harts Lane and Elmwood Road.
All traffic approaching the intersection of Harts Lane and Elmwood Road must come to a full stop prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. Such intersection is hereby designated as a stop intersection.
§ 160-101 Harts Lane and Louis Avenue.
All traffic approaching the intersection of Harts Lane and Louis Avenue travelling in a southerly direction on Louis Avenue, must come to a full stop prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. Such intersection is hereby designated as a stop intersection.
§ 160-102 Myton Lane at Pateman Circle.
All traffic approaching the intersection of Myton Lane at Pateman Circle must come to a full stop on the southbound Myton Lane approach prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. Such intersection is hereby designated as a stop intersection.
§ 160-103 Ruso Drive at Pateman Circle.
All traffic approaching the intersection of Ruso Drive at Pateman Circle must come to a full stop on the eastbound Ruso Drive approach prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. Such intersection is hereby designated as a stop intersection.

§ 160-104 Lower Sage Hill Lane at Sage Hill Lane.
All traffic approaching the intersection of Lower Sage Hill Lane at Sage Hill Lane must come to a full stop on the eastbound Lower Sage Hill Lane approach prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. Such intersection is hereby designated as a stop intersection.
§ 160-105 #23-27 Sage Hill Lane at Sage Hill Lane.
All traffic approaching the intersection of #23-27 Sage Hill Lane at Sage Hill Lane must come to a full stop on the westbound #23-27 Sage Hill Lane approach prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. Such intersection is hereby designated as a stop intersection.
§ 160-106 #11-17 Sage Hill Lane at Sage Hill Lane.
All traffic approaching the intersection of #11-17 Sage Hill Lane at Sage Hill Lane must come to a full stop on the westbound #11-17 Sage Hill Lane approach prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. Such intersection is hereby designated as a stop intersection.
§ 160-107 Intersecting Streets with Broadway
Intersecting Streets with Broadway, assumed to be installed and maintained by NYSDOT – Simmons Lane, Clifford Road, Tillinghast Avenue, Glenwood Road, Oakland Avenue, MacDonald Circle, MacDonald Circle Ext., and Harts Lane.
§ 160-108 North Sage Hill Lane and Sage Hill Lane
All traffic approaching the intersection of North Sage Hill Lane and Sage Hill Lane must come to a full stop on the northbound Sage Hill Lane and westbound North Sage Hill Lane approaches prior to entering
such intersection unless otherwise directed by a peace officer or traffic signal. Such intersection is hereby designated as a stop intersection.
§ 160-109 Ward Lane and Park Drive
All traffic approaching the intersection of Ward Lane and Park Drive travelling in a southerly direction on Park Drive, must come to a full stop prior to entering such intersection unless otherwise directed by a peace officer or traffic signal. Such intersection is hereby designated as a stop intersection.
§ 160-110 Penalties for Offenses.
Any person violating any provision of this article may, upon conviction, be punished for the first offence by a fine not exceeding $10.00 and for the second offence by a fine of not less than $10 nor more than $25 or by imprisonment for not less than two (2) not more than fifteen (15)000 days. The third or any subsequent offense within one year shall by a fine not exceeding $100 or imprisonment not exceeding six months or both such fine and imprisonment. *
ARTICLE XIV
Designation of Turn Warning Signs
§ 160-111 Clifford Road and Rail Road Avenue.
Intersecting Streets of Rail Road Avenue and Clifford Road, Yellow and Black Turn Warning Signs
to be installed and maintained by Menands Department of Public Works. There shall be Additional Turn Warning Signs in advance of the right angle on both roadways.
The resolution was seconded by Trustee Boulet. A Public Hearing was scheduled for Monday, February 5th, 2018 at 6:00 P.M. with the regular meeting to follow.

Trustee Boulet presented the following resolution for local law number 2 of 2018 amending the Village
Code 138 of the Village of Menands Abandoned Sign regulations. Be it enacted by the Village Board of the Village of Menands as follows:

§ 138-4 Definitions.
As used in this article, the following terms shall have the meanings indicated:
ABANDONED SIGN
Any sign which advertises, identifies or pertains to a business or activity no longer in existence. A sign which is not correctly directed at any person or advertising a bona fide business, lessor, owner, product or activity conducted or product available on the premises where such sign is displayed. This provision does not apply to seasonal activities during the regular periods in which they are closed.

§ 138-10 Illegal signs.
A. The following signs are deemed illegal signs and in violation under this article:
(1) Abandoned signs existing as such for over 30 days.
(2) Any sign erected for which no building or sign permit was issued by the Village of Menands, unless it is a nonconforming sign or exempt sign pursuant to this article.
(3) Any sign not properly maintained, such as, but not limited to, signs that are structurally unsound or are hazardous or unsafe.
B. The Building Inspector shall cause a notice of such violation to be served on the owner of the building, structure or lot where said sign is located or the lessee or tenant of the part of or the entire building, structure or lot where said sign is located, requiring the owner or lessee or tenant to remove the illegal sign within 10 business days. The notice may be served personally or by certified mail, return receipt requested. Upon failure of said owner or lessee or tenant to remove the sign within 10 business days after notice is provided, the Building Inspector and/or his authorized representative shall be authorized to enter upon said property and remove therefrom any said illegal sign at cost to the owner, lessee or tenant. The removal of such sign and the cost of such removal shall constitute a lien and upon certification by the Code Enforcement Officer to the Treasurer, shall be added to the next assessment roll and collected as a part the Village of Menands Taxes. No liability shall attach to the Village or any officers, employees or agents of the Village, except for acts of affirmative negligence in connection with the removal of any such illegal or abandoned sign.
C. In cases of emergency, the Building Inspector may cause the immediate removal of a dangerous or defective sign without notice.
D. Any sign for which a sign permit has been issued may be inspected for adequate maintenance, freedom from any hazardous condition and structural soundness. If a sign is found to be unsafe, the permittee shall have 30 days to correct any defect. If said defect cannot be corrected within 30 days, the Building Inspector may grant the permittee up to 30 additional days to correct it. If such defect has not been corrected by the expiration of 30 days or any additional period granted to correct it, the sign shall be illegal.

The resolution was seconded by Trustee Nicoll. A Public Hearing was scheduled for Monday, February 5th, 2018 at __:__ P.M. followed by the regular meeting.

Trustee Nicoll presented the following resolution for local law number 3 of 2018 amending the Village
Code 84 of the Village of Menands Removal of Graffiti. Be it enacted by the Village Board of the Village of Menands as follows:

CHAPTER 84
REMOVAL OF GRAFFITI

§ 84-1 Legislative intent.
It is the intention of the Village Board of the Village of Menands to prohibit the placement of graffiti on buildings or apartment structures and to require persons in charge of said building structure or property to remove the same so as to improve the quality of life and aesthetic nature of the Village of Menands.
§ 84-2 Definitions.
For the purpose of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:
BUILDING
Any structure used for commercial, business or residential purposes and any structure appurtenant to said use, such as garages, fences, retaining walls, facades or any other structure, located within the Village of Menands.
GRAFFITI
Any mark, figure, drawing, inscription or other notation, drawn, written, etched, painted or otherwise placed on any surface, building or property, inclusive of the use of stickers or paste-on stamps containing the marks defined herein, without the permission of the owner or occupant thereof.

OWNER
Any fee owner or other person exercising a legal possessive right and/or legal control over property.
PERSON
Includes any human being, corporation, partnership, authority, company, municipality, unincorporated association, special improvement district, fire company, the State of New York or any other entity able to sue or be sued.
PROPERTY
Includes any real property and appurtenances and personal property, including all trailers, vehicles or other similar personal property, wherever it may be.
§ 84-3 Prohibited acts.
No person shall make graffiti on any public or private building or other structure or any other real or personal property owned by others.

§ 84-4 Removal of graffiti.
The owner, tenant and/or person in control of any building or personal property shall be
required to remove any graffiti applied to such property not more than 15 days after such graffiti occurs. Failure to remove graffiti shall be a violation of this chapter.
B. Failure or refusal to remove graffiti.
(1) In the event that the owner, tenant and/or person in control of such a building, property or personal property shall fail or refuse to remove graffiti from his property, then said person or persons may be notified by certified mail, return receipt requested mailed to the property address, by the Code Enforcement Officer or his designated agent, that such person shall have a period of up to 15 days from receipt of such notice to complete removal or coverage of such graffiti.
(2) If such owner, tenant and/or person in control fails to comply with the terms of such notice within the time set forth therein, then the Village of Menands Code Enforcement Officer may order employees of any Village department or a contractor with an agreement approved by the Village Board to engage in maintenance, repair and other services needed to effectuate the elimination or coverage of such graffiti on such property. All costs of such work shall be billed to the owner of the property and, if unpaid after 90 days, shall be re-levied for inclusion as taxes upon such parcel of property as was benefitted thereby.
§ 84-5 Enforcement.
It shall be the duty of any peace officer, police officer of the Village of Menands or any duly authorized agent of the Village of Menands who is authorized to issue an appearance ticket or otherwise designated by the Village Board of the Village of Menands to enforce the provisions of this chapter against any person found to be violating the same.
§ 84-6 Penalties for offenses.
Any violation of any section of this chapter shall be punishable by imprisonment of up to 15 days and/or a fine of not less than $250 nor more than $1,000.

There was a discussion regarding incorrect water/sewer usage for the period May 1, 2017 to October 31, 2017. Trustee Boulet offered, seconded by Trustee Foley the following resolutions:

WHEREAS, Water and Sewer Acct. #. 510000317 for 15 A Elmwood Road Ext. in the amount of $4,254.90 was based on an incorrect reading. Now, therefore, be it

RESOLVED, that a total of $2,474.15 be deducted from the original water roll total for the period May 1, 2017 to October 31, 2017, and be it further

RESOLVED, that a total of $1,113.37 be deducted from the original sewer roll total for the period May 1, 2017 to October 31, 2017, and be it further

There was a discussion regarding incorrect water/sewer usage for the period May 1, 2017 to October 31, 2017. Trustee Boulet offered, seconded by Trustee Foley the following resolutions:

WHEREAS, Water and Sewer Acct. #510000181 for 442 E Broadway in the amount of $946.43 was based on an incorrect reading. Now, therefore, be it

RESOLVED, that a total of $388.16 be deducted from the original water roll total for the period May 1, 2017 to October 31, 2017, and be it further

RESOLVED, that a total of $174.67 be deducted from the original sewer roll total for the period May 1, 2017 to October 31, 2017, and be it further

Eric Johnson from Chazen Companies spoke about a recent meeting he had with Mike Hagmann, Bill Smith, Don Handerhan regarding what sewer pipes to meter and scope. There will be a resolution at the next meeting to start work. A discussion followed.

The Clerk informed the Board that National Grid will be completing an audit of public street lights to be completed by Spring.

He also asked the Board if they wanted to continue the monthly monitoring by PayChex at $65 per month. After a discuss the Board decided to cancel the contract.

The Clerk advised the Board of two water main breaks Menand Road and Amsterdam Avenue. DPW investigated three other possible breaks. There was a power problem at the Wards Pump Station. The problem was a burned-out fuse. The pump station is up to full service.

Trustee Boulet advised the Board that a meeting was held with past presidents of the youth baseball. It was a very productive meeting. There will be a new board in place very soon. Families are starting to sign up.

The Mayor stated that 125 Broadway has been sold to a company that is in the business of self-storage.
Also, the Menands Diner was sold at auction back in April unknown who owns property or their plans.

The Mayor advised the Board that the Village did not get the NYS Department of State/CFA Grant for $41,250.00 to create a Comprehensive Plan. After a discuss it was decided to continue with SUNY Project and hire a consultant after SUNY Project is complete.

A motion was made by Trustee Foley to hire a consultant to complete a comprehensive plan in conjunction with the work performed by U Albany students. Contingent upon the reimbursement HRVG grant of $9,900 and previously approved matching funds of $2,500 and $13,750, additional funds up to $25,000 are approved for consulting fees. The motion was seconded by Trustee Nicoll.
