Board Meeting Minutes – November 20th, 2017

The regular semi-monthly meeting of the Board of Trustees of the Village of Menands, held on Monday, November 20th, 2017 was called to order by Mayor Megan Grenier at 6:00 P.M.

The Mayor led the Pledge of Allegiance.

Open Forum:

Resident Brian Marsh inquired if there had been a reply from National Grid on the power fluctuation on Van Rensselaer Blvd.

Resident Paul Cooney inquired about the sign Audit. The Mayor said a presentation to the Board is being scheduled for the next meeting.

Resident Bill Moreland inquired about the progress on the 5 Elmwood Apartment Complex. The Mayor explained due to changes in the project it will have to going back for another Public Hearing by the ZBA for approval due to changes.

Mr. Moreland also inquired about the abandon tank on Glenwood Road. The Mayor explained the Village has been in touch with the owner but not sure of the outcome.

Resident Kristen Winner inquired about the NO PARKING signs for Jones Court. The Mayor explained that a public hearing will be set up to amend the current Local Law.

A motion was made by Trustee Boulet, seconded by Trustee Foley to approve minutes from the November 1st & 14th, 2017 Insurance Workshop Trustee Nicoll abstained.

A motion was made by Trustee Boulet, seconded by Trustee Foley to accept the minutes of the November 6th, 2017 Board Meeting.

A motion was made by Trustee Nicoll, seconded by Trustee Boulet to approve payment for the following:

WARRANT # 12:

WATER totaling $ 68,737.02
SEWER totaling $ 43,648.00
TOTALS $544,924.37

Village Attorney stated a decision on the Site Plan Application for 35 Broadway needs to be decided within 62 days. Attorney Rehfuss feels that a decision need to be made by the next meeting which will be Monday, December 4th one of the following things could happen:

The Board could deny the Special Use Permit
Grant the Special Use Permit with additional conditions
The Board could wait to see the Escrow Check comes in before the next meeting or they could change the wording.

The Mayor explained that there will be Public Hearing on Tuesday, December 5th at 5:00 P.M. to provide information on a project in collaboration with the University at Albany Department of Geography and Planning, Masters in Regional Planning Program Graduate Studio.

The Mayor stated to answer a concern resident Bill Garvey voiced at a previous meeting the guide wire on Villa Road has been removed.

Trustee Harris moved the following resolution concerning Health, Dental, and Vision Insurance for eligible Village Employees and retirees. For the calendar year the Village will offer the following plans.

The current MVP Platinum 1 EPO; a MVP Gold 4 EPO; and a MVP Gold 1 EPO, along with the current Guardian Dental and Vision Plans. On January 1st eligible employees will have a 17% employee responsibility, however, beginning with the Fiscal year 6/1/18 the employee responsibility will increase to 18% of the total monthly cost of the Health, Dental, and Vision options selected. (Union contracts will supersede the % of employee responsibility and Health Plans.) Non-Medicare retires will have the same choices (except without Dental and Vision Coverage) and Health Plans.) Non-Medicare retires will have the same choices (except without Dental and Vision coverage) with a retiree responsibility of 12%. Medicare eligible retirees will continue to be offered the CDPHP Medicare advantage plan with a 12% retiree responsibility. The resolution was seconded by Trustee Nicoll.

Trustee Nicoll introduced an amendment to Local Law #5 of 2001

§ 160-66. Parking prohibited in certain locations. [Amended 6-7-1993 by L.L. 2-1993; 7-19-1993 by L.L. No. 3-1993; 11-15-1993 by L.L. No. 4-1993; 9-7-1999 L.L. No. 1-9999;7-2-2001 by L.L. No. 2-2001; 8-20-2001 by L.L. No. 5-2001]

It shall be unlawful and a violation of this article for an owner or operator of any vehicle to park or permit his vehicle to be parked or to abandon his vehicle:

A. On the west side of North Pearl Street from a point 127 feet south of Amsterdam Avenue to the end thereof north of Amsterdam Avenue.

B. On the north side of Clifford Road from Broadway west to the west end thereof.

C. On both sides of Hampton Street between Amsterdam Avenue and Wolfert Avenue.

D. On the east side of Park Hill Drive from Wards Lane to a point on the east side of said Park Hill Drive 439 feet to the north thereof.

E. On either side of Amsterdam Avenue east of North Pearl Street to the end thereof.

F. On the east side of North Pearl Street from a point +/-83 feet south on North Pearl Street.

G. On either side of Jones Court.

RESOLUTION OF THE BOARD OF TRUSTEES
OF THE VILLAGE OF MENANDS

In the matter of adding an
Optional form of payment to the
Village of Menands
Volunteer Firefighter
Service Award Program

WHEREAS; Eligible voters of the Village of Menands approved a proposition to establish a Service Award Program for active volunteer firefighter members of the Menands Fire Company No. 1, Inc. effective January 1, 1994, in accordance with Article 11-A of the New York State General Municipal Law (herein NYS GML); and,

WHEREAS; Under the Village of Menands Volunteer Firefighter Service Award Program, Participants are paid a lump-sum Accrued Service Award after reaching the Entitlement Age of 60: and,

WHEREAS: NYS GML authorized the Village Board of Trustees of the Village of Menands (herein Board) to provide optional forms of payment: and,

WHEREAS; The New York State tax law was amended in 2014 to exempt from New York State income tax, periodic payments made to an individual over age 59 ½ from a service award program adopted in accordance with Article 11-A; and,

WHEREAS; The Board wishes to allow participants to have the option to take advantage of the New York State tax exemption; and,

WHEREAS; The Board has been advised by Penflex, Inc., the firm retained to assist the Board with the administration of the Program, on how the payment options can be modified to allow participants to take advantage of this New York State tax exemption; and,
Now, Therefore, BE IT RESOLVED, Effective January 1, 2018, the Board amends the Plan Document Section 19, Form of Payment of Accrued Service Award, as follows:

At Benefit Commencement Date a Participant has the option to be paid his or her Accrued Service Award in one of the following forms:

i A one-time lump-sum.

ii In two (2) annual installment payments. Should a Participant elect to be paid in two (2) annual installment payments, the first payment shall equal one-half (1/2) of the lump sum he or she would have otherwise been paid. The second payment shall be equal to the remaining balance of the Accrued Service Award calculated as of the next following December 31st, reflecting actual investment income and/or expenses or other transactions that occurred during the Program Year. Should the Participant die before being paid the second installment, the second installment will be paid as scheduled to the Designated Beneficiary.

All other provisions of the Village of Menands Volunteer Firefighter Service Award Program shall not change; the program shall continue to be administered by the Board in accordance with Article 11-A of the New York State General Municipal Law as such law is amended from time to time.

Trustee Nicoll moved, Trustee Foley seconded the above resolution on the Service Award Program payment options.

The Board was informed that the Senior Citizens Christmas Party will be Sunday, December 2nd, 2017 from 1:00 P.M. to 4:00 P.M.

The Clerk informed the Board that the Youth Christmas Party will be Friday, December 8th, 2017 Santa’s Magical Express in East Greenbush. The bus leaves Ganser Smith Park at 5:30 P.M. for the youth groups 6:00 P.M. reservation.

The Clerk informed the Board that the Annual Christmas Party for employees, retired employees and their guests will be held on Thursday, December 14th, 2017 from 3:00 P.M. to 6:00 P.M. at Poppy’s Place.

A motion was made by Trustee Boulet, seconded by Trustee Foley to adjourn.
